Important Requirements Before Your Appointment
Divorce and child custody paperwork can be very document-specific, and some documents must be signed, notarized, witnessed, and filed in a specific order. We cannot tell you which forms to use, what order to complete them in, or who should sign which document. Before your appointment, review your court, clerk, attorney, or filing instructions carefully. Your documents should be fully completed before the appointment, and you should know who needs to sign each document and when. If you do not have clear instructions, check our resource page for detailed guidance available for some situations.
We do not provide legal advice or tell you which divorce or custody form to file.
One limited exception may apply for a Provisional Custody by Mandate; a Civil Law Notary is permitted to prepare this document.

Provisional Custody by Mandate
A Provisional Custody by Mandate is a Louisiana document that gives another adult temporary authority to care for a child in certain situations.
What to know:
- This document can authorize the other person to handle matters involving the child’s health, education, and general welfare, such as medical care and school enrollment.
- It is valid for a maximum of one year. The parent can set a shorter period of time.
- This is different from a court custody order and does not create permanent custody.
- The document should follow the Louisiana form.
- This document also requires two witnesses in addition to the parent and the mandatory.
- A Louisiana Civil Law notary is allowed to prepare this document. We have these forms.
- If you need more clarity on Provisional Custody by Mandate, check our Resources Page Under Divorce, Child Custody and under LouisianaLawHelp.org. Look for the link for Provisional Custody by Mandate Information & Forms.
Divorce Filings
Divorce filings may include petitions, verifications, waivers, affidavits, and other prepared court forms that require notarization as part of a Louisiana divorce case.
What to know:
- Many people using these forms are handling an uncontested divorce, self-represented divorce, or a divorce without a lawyer.
- The process can feel long or confusing, but the court and Louisiana self-help instructions are often detailed and step-by-step. Review your packet carefully before the appointment.
- Have the exact court packet, attorney-prepared document, or self-help form you were given.
- If you do not have instructions, check our Louisiana Resources Page before your appointment for official and self-help sources, which may include 102 divorce or 103 divorce checklists
- We notarize the signature portion of properly prepared divorce documents, but we do not tell you which forms to file or what order to file them in.
Child Custody Filings
Child custody filings may include prepared court forms, affidavits, sworn statements, and related documents that require notarization.
What to know:
- Have the completed form and any instructions from the court, attorney, or self-help source.
- Custody documents can vary widely by case type, parish, and whether the matter is temporary or ongoing.
- All forms needing notarization must be signed in front of the notary, and some may also require witnesses.
- The signer’s name must match the name on the documents.
- We do not choose custody forms or give legal advice.
- A Louisiana Notary is only allowed to prepare a Provisional Custody by Mandate. Any other types of Custody forms you must have already filled out and be ready to sign.
- On our Resources page under “Family, Paternity, Minor & School-Related Resources,” look for the LouisianaLawHelp.org website. They have very helpful information about the different types of custody.
Ex Parte & Supporting Affidavits
Ex parte filings often include a sworn affidavit, verification, or supporting statement that must be signed and notarized as part of a prepared family court filing.
What to know:
- Have the exact ex parte form, affidavit, and any supporting pages you were given by the court, attorney, or self-help source.
- These filings are often submitted as a packet, so review your instructions carefully and make sure the documents are complete before the appointment.
- Some ex parte paperwork must be signed in a specific order or filed together with related attachments. We do not advise on filing steps or case procedure.
- Wait to sign in front of the notary when possible. If your document has already been signed, contact us before assuming it cannot be used.
- We can not advise you or help you fill these forms out.
In Forma Pauperis Affidavit
An In Forma Pauperis affidavit, often called an IFP affidavit, is commonly used when someone is asking the court to consider a filing fee waiver based on financial need.
What to know:
- Have the exact court or clerk form you were given, along with any filing instructions.
- Complete the non-signature portions before the appointment.
- Many IFP affidavits also require a third party to complete and sign a separate supporting affidavit.
- It is usually easiest if that third-party affiant can meet with the notary at the same appointment as the person signing the IFP affidavit.
- Court acceptance depends on the court or clerk, not the notary.
Other Family Court Documents
Some family court documents fall outside the more common divorce, custody, and ex parte categories but may still require notarization.
What to know:
- Examples may include sworn attachments, supporting declarations, consent forms, and related court paperwork.
- Have the completed document and any instructions from the attorney, court, or self-help source.
- All notarized documents must be signed in front of the notary
- Some documents may also require witnesses.
- Filing and signing requirements can vary depending on the court, judge, and document type.
